What is a trademark?

A trademark is any word, name, logo, symbol, colour combination, shape or sound that identifies your goods or services and distinguishes them from everyone else’s. Put simply, it is your brand — protected in law.

Registration under the Trade Marks Act, 1999 makes you the legal owner of the mark across India. Without it, stopping someone who copies your brand is slow, expensive and uncertain.

What is a trademark class?

Goods and services are divided into 45 classes under the international Nice Classification — classes 1–34 cover goods and 35–45 cover services. You register your mark in each class that matches your business, and can apply in several classes at once.

How long is a registered trademark valid?

Ten years from the date of application. It can be renewed every ten years, indefinitely, on payment of the renewal fee.

When can I use ™ and ®?

You can use ™ with any mark you claim as yours, including once your application is filed. The ® symbol may be used only after the trademark is registered — using it earlier is an offence.

How long does registration take?

The application can be filed within a few working days of receiving your documents. If there are no objections or oppositions, the full process — examination, publication in the Trade Marks Journal and a four-month opposition window — typically takes 12 to 24 months.

How do I check whether my brand name is available?

Search the IP India public search tool before applying. We run this search, and check phonetically and visually similar marks, as part of every application.

Why do trademark applications get objections?

Common reasons are similarity to an existing mark, descriptive or generic words, geographical names, and missing information. For example, “Car” cannot be registered for cars but could be registered for electronics. We draft a reply if an objection is raised.

Can I file in my own name?

Yes. A trademark can be filed by an individual, proprietor, company, LLP, partnership, trust, society or HUF. Individuals, start-ups and small enterprises pay a lower government fee per class than other applicants.

Is an Indian trademark valid abroad?

No — registration under the Trade Marks Act, 1999 protects the mark in India only. International protection can be obtained through the Madrid Protocol, administered by WIPO.

Do I need to visit your office?

No. The entire process is online. All you need is an internet connection and your documents, wherever you are in India.
